Terms of Service

The Short Version

These terms govern your use of MavenPay and form a single contract between you and the MavenPay entities. The MavenPay financial service is provided by Maven Pay Inc. (Canada). Travel and flight bookings are provided by Maven Pay Concierge Private Limited (Singapore). eSIM data and mobile top-up are provided by MavenPay Concierge Broker F.Z.E (UAE). All three are MavenPay group entities.

1. Introduction

These terms govern your use of MavenPay and form a single contract between you and the MavenPay entities described below.

The MavenPay financial service is provided by Maven Pay Inc. (Canada). Travel and flight bookings are provided by Maven Pay Concierge Private Limited (Singapore). eSIM data and mobile top-up are provided by MavenPay Concierge Broker F.Z.E (UAE). All three are MavenPay group entities. The contract is one document and you accept it once when you open your MavenPay account.

2. Who You Are Contracting With

For the MavenPay financial service, you contract with Maven Pay Inc., a company incorporated in Canada, with its registered office at 130 Spadina Avenue, Unit 807C, Toronto, ON M5V 2L4, Canada. Maven Pay Inc. is the regulated party that provides currency exchange, money remittance, payment services, card services, multi-currency banking, crypto trading, and stablecoin features.

For travel and flight bookings made through MavenPay, you contract with Maven Pay Concierge Private Limited, a company incorporated in Singapore, with its registered office at 2 Venture Drive, #19-21, Vision Exchange, Singapore 608526. The clauses headed "Concierge Travel" below apply to your bookings.

For eSIM data and mobile top-up purchased through MavenPay, you contract with MavenPay Concierge Broker F.Z.E, a company incorporated in the United Arab Emirates, with its registered office at Ajman Free Zone C1 Building, Ajman Free Zone Business District, B.C. 1306178, UAE. The clauses headed "Concierge eSIM and Mobile Top-Up" below apply to your purchases.

3. Eligibility

You must be eligible to open an account in your jurisdiction. You must not be a citizen of, ordinarily resident in, or primarily doing business in a country that we do not serve. The list of countries we do not serve, and the countries where we accept only customers who pass enhanced due diligence, is described in our Country Acceptance Disclosure.

When you open an account, you confirm that you are not subject to economic sanctions, that you are not acting on behalf of a sanctioned person or entity, and that you will tell us if your status changes.

4. Opening And Operating Your Account

You agree to give us accurate and complete information when you open an account and to update it when it changes.

We may decline to open an account, decline to activate a feature, suspend an account, or close an account if we cannot complete identity verification or sanctions screening to our standards, if we have reason to believe the account is being used for fraud, money laundering, terrorist financing, or any activity that breaches these terms or our Acceptable Use Policy, if we are required to do so by an order, direction, or notice from a court or competent authority, or if the account has been inactive for an extended period.

You are responsible for keeping your login credentials, your password, and any device you use to access MavenPay secure. Tell us immediately at support@mavenpay.com if you believe your account has been accessed without your authorisation.

You are responsible for everything done through your account, except for unauthorised access that we agree on review was not caused by your own breach of these terms.

5. Using The Service

You may use MavenPay to send and receive funds in the currencies and corridors we support, to hold balances in those currencies, to convert between currencies at the rates we display before you confirm, to issue and use payment cards where the relevant card programme is available to you, to send and receive stablecoin payments where the relevant stablecoin rail is available to you, to connect a bank account through Plaid for the purposes described below, and to book travel, flights, eSIM data, or mobile top-up through the Concierge services where available.

You may not use MavenPay for any activity that breaches the law of the jurisdictions where you operate, or that breaches our Acceptable Use Policy.

6. Connecting A Bank Account

When you connect a bank account, you authorise Maven Pay Inc. to use Plaid Inc. on your behalf to access and transmit your financial information from your bank, in accordance with the Plaid End User Privacy Policy at https://plaid.com/legal/#end-user-privacy-policy and the Plaid End User Services Agreement at https://plaid.com/legal/#end-user-services-agreement-us. You can disconnect a connected bank account at any time in the MavenPay product.

7. Stablecoin Settlement Via Bridge

Where your stablecoin settlement is routed through Bridge, you also agree to the Bridge User Agreement and Bridge Privacy Policy applicable to your jurisdiction, available at https://www.bridge.xyz/legal/overview. Maven Pay Inc. is not authorised as a crypto-asset service provider under the European Union Regulation 2023/1114 on markets in crypto-assets. For the Bridge-routed services in scope of that regulation, Bridge is the regulated party in that jurisdiction.

Stablecoin and crypto features may also be routed through other regulated infrastructure providers. The identity of the provider for each feature, and the terms and privacy policy of that provider where we are required to surface them to you, are disclosed at the point where you activate the relevant feature.

8. Cards

Payment cards issued through MavenPay are subject to the Card Program Disclosures, including the name of the issuing bank and any specific terms that bank requires us to surface to you. The Card Program Disclosures form part of these terms. The card scheme rules of the relevant card network also apply to your use of the card.

9. Concierge Travel

This section applies to your travel and flight bookings made through MavenPay. Your contract for travel and flight bookings is with Maven Pay Concierge Private Limited (Singapore).

Maven Pay Concierge Private Limited sources hotel inventory, flight inventory, ground transfers, and related travel inventory from third-party travel-distribution providers. Maven Pay Concierge Private Limited is the contracting party for your booking. The underlying airline, hotel, ground operator, or travel provider remains the supplier of the travel service itself.

Change, cancellation, and refund rules vary by airline, hotel, and supplier. The applicable rules are surfaced to you before you confirm a booking and form part of your booking confirmation. Where a supplier rule conflicts with these terms, the supplier rule governs the change, cancellation, or refund for that specific booking.

You are responsible for ensuring that you, every other traveller on the booking, and any companion you bring hold the documentation required to travel, including a valid passport, any visa or permit required by the origin, transit, and destination country, any health declaration required by the destination country, and any insurance the destination country requires. Maven Pay Concierge Private Limited does not verify the validity of your travel documents and is not responsible for refused boarding, refused entry, deportation, or any other consequence of inadequate or invalid travel documents.

You acknowledge that flight times, gate assignments, hotel room categories, and other booking details are set by the supplier and may change after you confirm. Maven Pay Concierge Private Limited passes supplier notifications to you and assists you through the MavenPay product where it can, but is not liable for losses that arise from a supplier-driven change unless the law of your jurisdiction provides otherwise.

You are responsible for your own travel insurance.

10. Concierge eSIM And Mobile Top-Up

This section applies to your eSIM data and mobile top-up purchases made through MavenPay. Your contract for these purchases is with MavenPay Concierge Broker F.Z.E (UAE).

MavenPay Concierge Broker F.Z.E resells eSIM data plans and mobile top-up across the mobile-network operators in the countries where this service is available to you. The underlying mobile-network operator remains the supplier of the connectivity service itself.

Operator-specific delivery times, coverage maps, supported devices, refund rules, validity periods, and roaming limitations are surfaced to you before you confirm a purchase. Refunds for unused balance, for partial use, or for inability to activate are governed by the operator's policy for the specific product you purchased. Where a refund is available it is processed to the original payment method.

You are responsible for ensuring that the device you intend to use supports the eSIM profile or the mobile top-up you purchase. MavenPay Concierge Broker F.Z.E is not responsible for an inability to activate a product on a device that does not support it.

You are responsible for compliance with the law of the country where you activate or use the eSIM or mobile top-up, including any registration or identity-disclosure requirement the local regulator imposes on prepaid mobile services.

11. Fees, Exchange Rates, And Limits

Our fees, exchange-rate mark-ups, and per-account or per-feature limits are disclosed at the point where you confirm a transaction and on the fee schedule at mavenpay.com/pricing. Where a fee changes, we give you at least thirty days notice before the change takes effect.

12. Payment Instructions And Processing

Once you confirm a payment instruction, we begin processing it. We may decline, delay, or reverse a payment instruction if we suspect fraud, sanctions exposure, or any breach of these terms or applicable law, if our compliance controls require additional information from you before we can complete the instruction, or if a counterparty bank, card network, stablecoin rail, or other infrastructure provider declines or returns the instruction.

We will tell you the reason for a decline or delay where the law allows us to.

13. Records, Statements, And Taxes

You are responsible for your own tax compliance. We provide statements and transaction records in the MavenPay product so you can meet your tax-reporting obligations. We may share information with tax authorities when the law requires us to.

14. Electronic Communications And Electronic Signature

You agree that we may communicate with you electronically, including through the MavenPay product, by email, by SMS, or by in-product notification, and that any electronic communication satisfies any legal requirement that we communicate with you in writing. You agree that your acceptance of these terms, the Privacy Policy, the Cookie Policy, the Acceptable Use Policy, the Card Program Disclosures, and any other policy referenced in these terms may be given by electronic means, and that such acceptance has the same legal effect as a handwritten signature.

15. Intellectual Property

The MavenPay product, brand, trademarks, software, documentation, and content are owned by Maven Pay Inc. or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use them for the purpose of accessing the service. You do not get any other right or interest in them.

16. Changes To These Terms

We may update these terms from time to time. When we make a material change, we will tell you in the MavenPay product or by email at least thirty days before the change takes effect. If you do not accept the change, you may close your account before the change takes effect. Continuing to use MavenPay after the notice period means you accept the change.

17. Termination

You may close your account at any time, subject to settlement of any pending transactions and to our record-keeping obligations under the law.

We may close your account, terminate your access to a feature, or terminate this contract immediately if you breach these terms or the Acceptable Use Policy, if we are required to do so by an order or direction from a court or competent authority, or if we determine, acting reasonably, that we can no longer support your account because of risk, regulatory, or partner constraints.

If your account is closed by us, we will return any balance you hold to a bank account, card, or wallet you nominate, after deducting any amounts you owe us and after any holds that the law requires us to apply.

18. Liability

To the extent permitted by law, Maven Pay Inc. is not liable for indirect, consequential, special, incidental, exemplary, or punitive losses, including loss of profit, loss of revenue, loss of business, loss of goodwill, or loss of data.

Our total aggregate liability for any claim or series of related claims arising under or in connection with these terms is capped at the fees you paid to Maven Pay Inc. in the twelve months immediately preceding the event that gave rise to the claim.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under the law that applies to you, including liability for fraud, fraudulent misrepresentation, gross negligence, or death or personal injury caused by negligence.

19. Indemnity

You agree to indemnify Maven Pay Inc. and the other group entities listed in our Privacy Policy against any third-party claim, loss, damage, fine, or expense arising from your breach of these terms, your breach of the Acceptable Use Policy, your breach of the law that applies to you, or any unauthorised use of your account caused by your own breach of these terms.

20. Disputes And Complaints

If something goes wrong, raise it with us first at support@mavenpay.com. Our Complaints and Disputes page describes the internal process we follow and the external escalation paths available in your jurisdiction.

21. Governing Law

These terms are governed by the law of the Province of Ontario, Canada, and the federal laws of Canada applicable in Ontario.

Disputes arising under or in connection with these terms are subject to the non-exclusive jurisdiction of the courts of the Province of Ontario, Canada. Nothing in this clause prevents you from bringing a claim in the courts of your country of residence, or from using a consumer-protection or out-of-court complaint mechanism that the law of your country of residence makes available to you.

22. Entire Agreement

These terms, together with the Privacy Policy, the Cookie Policy, the Acceptable Use Policy, the Card Program Disclosures where they apply to you, the Crypto-Asset Disclosures where they apply to you, and any other policy referenced here, are the entire agreement between you, Maven Pay Inc., Maven Pay Concierge Private Limited, and MavenPay Concierge Broker F.Z.E for your use of MavenPay.

23. Severability And Waiver

If any part of these terms is held to be unenforceable, the rest remains in effect. A failure or delay by Maven Pay Inc. to enforce any right under these terms is not a waiver of that right.

24. Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign or transfer our rights and obligations to a member of the MavenPay group or to a successor in connection with a merger, acquisition, or sale of assets, on at least thirty days notice to you.
